MyMoose Terms of Use

By accessing or using the “MyMoose” website or mobile applications (collectively referred to as the “Service”) you agree to be bound by these Terms of Use. The Service is owned and controlled by Goldstream Publishing Incorporated. If you do not agree to be bound by all of these Terms of Use, do not access or use the Service.

Code of Conduct

  1. You may not post nude, discriminatory, unlawful, hateful or pornographic photos on the Service.
  2. You must not defame, stalk, bully, abuse, harass, threaten, impersonate, or intimidate people or entities.
  3. You must not post private or confidential information via the Service.
  4. You must not use the Service for any illegal or unauthorized purposes.
  5. You are responsible for your conduct and any content posted to the Service.
  6. Violation of these Terms of Use, in Goldstream Publishing’s sole discretion, may result in the termination of your MyMoose account.

Privacy and Rights of Use

  1. MyMoose will not release GPS location data for any content submitted, including photos and surveys. It will only release: (i) Region level data to the public when authorized, and (ii) Wildlife Management Unit data to biologists and other authorized users of the data.
  2. MyMoose does not claim ownership of any content and data that is posted to the Service. Instead you grant MyMoose a non-exclusive, fully paid and royalty free, transferable, sub-licensable world-wide license to use content that you post on or through the Service, subject to conditions of our privacy policy.
  3. Some of the Service may be supported by advertising and promotions and may appear within the Service.
  4. You represent and warrant that any content posted by you on the Service is rightfully yours to post and does not infringe any copyrights, trademarks or other intellectual property rights.

General Terms

  1. We reserve the right to modify or terminate the Service for any reason, without notice, at any time, and without liability to you.
  2. From time to time, we may update these Terms of Use and you agree that we may notify you of the updated terms by posting them on the Service.
  3. You can deactivate your MyMoose account by logging into the Service and completing the form available http:/www.mymoose.ca/user/deactivate/ If your account is terminated or deactivated your account, surveys, photos and all other data will no longer be accessible through your account but those materials and data may persist within the Service.
  4. We reserve the right to refuse access to the Service to anyone at anytime for any reason.
  5. We reserve the right to force forfeiture of any username for any reason.
  6. You are responsible for all data charges you incur through use of the Service.
  7. The Service is provided on an "as is", “as available, and “with all faults” basis. To the fullest extent permissible by law, neither MyMoose nor its parent company make any representations or warranties or endorsements of any kind whatsoever, express or implied, as to the Service.
  8. You agree to defend (at our request), indemnify and hold MyMoose, its parent company and employees harmless from and against any claims, liabilities, damages, losses, and expenses, including without limitation, reasonable attorney's fees and costs, arising out of or in any way connected with your content or your access to or use of the Service.
  9. These Terms of Use are governed by and construed in accordance with the laws of the Province of British Columbia. For any action at law or in equity relating to the arbitration provision of these Terms of Use, you agree to resolve any dispute you have with MyMoose exclusively in a court located in British Columbia, Canada.
